Data Protection Principles

Personal data must be processed in accordance with six ‘Data Protection Principles.’ It must:

  • be adequate, relevant and limited to what is necessary for the purposes for which it is processed;

How do we use your personal data?

Metzger Search & Selection Ltd will use your personal data where we have a legitimate interest.

All the data we collect and process from you will only be used in relation to our recruitment activities. This is to support candidates in their search to find a new role/employment and to comply with contract agreements with clients.

We use certain personal data to determine which candidates might be worth approaching for a particular role. This is necessary for our legitimate interests as a recruitment company.

Who do we share your personal data with?

  • Metzger Search & Selection clients to introduce candidates to them.
  • Third parties who perform functions on behalf of Metzger Search & Selection Ltd, and who also provide services to us, such as executive research consultants, IT consultants carrying out maintenance and development work on our IT systems, referencing, criminal reference checking services, psychometric evaluations or skills tests, accountants and lawyers). These third parties comply with similar and equally stringent undertakings of privacy and confidentiality
  • Where required we share your personal information with third parties to comply with a legal obligation; when we believe in good faith that an applicable law requires it; at the request of governmental authorities conducting an investigation; to verify or enforce our Terms of Use or other applicable policies; to detect and protect against fraud, or any technical or security vulnerabilities; to respond to an emergency; or otherwise to protect the rights, property, safety, or security of third parties, visitors to our website, our business or the public.

How long do we keep your data for?

  • If we have not had contact with you (or, where appropriate, the company you are working for or with) for a period of three years, we will delete your personal data from our systems unless we believe in good faith that the law or other regulation requires us to preserve it (for example, because of our obligations to tax authorities or in connection with any anticipated litigation).

Your rights

Under the GDPR and the Data Protection Act 2018 (DPA 2018) you have a number of rights with regard to your personal data.

  • The right to information about what personal data we process, how and on what basis as set out in this Privacy Statement.
  • The right to access your own personal data by way of a subject access request. Identification will be requested for security.
  • The right to correct any inaccuracies in your personal data.
  • The right to request that we erase your personal data, however this would only be where we were not entitled under the law to process it or it is no longer necessary to process it for the purpose it was collected.
  • The right to object to data processing where we are relying on a legitimate interest to do so and you think that your rights and interests outweigh our own and you wish us to stop.
  • The right to object if we process your personal data for the purposes of direct marketing.
  • The right to receive a copy of your personal data and to transfer your personal data to another data controller. We will not charge for this and will in most cases aim to do this within one month.
  • With some exceptions, the right not to be subjected to automated decision-making. Metzger do not carry out automated decision making and profiling
  • In most situations, the right to be notified of a significant data security breach concerning your personal data.
  • In most situations we will not rely on your consent as a lawful ground to process your data. If we do however request your consent to the processing of your personal data for a specific purpose, you have the right not to consent or to withdraw your consent later.
  • We want to make sure that your personal information is accurate and up to date. Please contact us to correct or remove information you think is inaccurate or out of date.

Data Breaches

We have robust measures in place to minimise and prevent data breaches from taking place. Should a breach of personal data occur (whether in respect of you or someone else) then we will keep notes and evidence of that breach. We will also contact you. If the breach is likely to result in a risk to the rights and freedoms of individuals, then we will also notify the Information Commissioner’s Office within 72 hours.

Subject Access Request (SAR)

You have the right to access information we are processing and obtain information about how we process it.

Any such request must be made in writing and a copy of the information will be sent to you no later than one month from when we received your request unless the request is complex or numerous in which case the period in which we must respond can be extended by a further two months.

There is no fee for making a SAR. However, if your request is manifestly unfounded or excessive we may charge a reasonable administrative fee or refuse to respond to your request.

Our legal basis for processing your data

We will collect and process your personal data (which may include sensitive personal data) for the purposes of finding you a new role/employment. The legal basis we rely upon to offer you these services are:

  • Legitimate Interests - Under data protection law there are some circumstances where we may rely on a legitimate interest to process your personal data. We can do this if we have a genuine and legitimate reason and we are not harming your rights and interests and we feel the following activities allow us to provide a more efficient and bespoke service;
  • In order for us to continue providing services to candidates and clients we need to process your data for internal administration
  • We consider it reasonable to expect that if you’ve posted your information and CV on a job board or professional site, you are happy for us to collect and/or use your data to offer our services to you.
  • We introduce candidates to clients and therefore the sharing of data, with your consent, is an essential part of this process in helping you secure the job you want.
  • We have our own obligations under the law and therefore may share your data in relation to tax collection, crime detection or litigation cases.
  • We store supplier data to enable the receipt of services from you as well as financial details to pay you for your services.
  • As a referee, we use your personal data in order to contact you for a reference.

Transferring your personal information outside the European Economic Area

We occasionally transfer personal information out of the EEA where we are working with clients who have a business presence outside of the EEA. In these circumstances we would only transfer your personal information, with your consent, to clients who comply with similar and equally stringent undertaking of privacy and confidentiality.
